The Surrogacy Act 2010 (Qld) makes specific provisions for surrogacy arrangements to be given effect between the birth mother and the intended parent or parents of the child. There are however certain legal requirements and restrictions in regards to these arrangements.
It remains illegal to enter into such an arrangement on a commercial basis between the parties and legitimate arrangements need to be finalised before the birth mother becomes pregnant.
We can assist either party in understanding their legal obligations involved and walk them through the process step by step including:
- Explaining the importance of a medical or social need for a surrogacy arrangement;
- Who is an eligible woman;
- Registering the birth;
- The importance of Counselling through the entire process; and
- Transferring the parentage of the child.
